The higher education has been reshaped through e-learning and the digitization of teaching materials and teaching methods. Potentially, these pedagogical processes mediated by new technology ensure that distance will no longer be an obstacle to equal participation in higher  education.Although in principal universities claim to prioritize student equity in fact the incarcerated students have limited access to higher education and therefore the inequality in access to higher education is perpetuated. This paper explores deeper problems within the digitized university, education in Restorative justice practice, and society’s equality of opportunity parameters.
