Abstract
Within the frame reference of the EU there has been aspiration – besides the collaboration among the Member States in the affairs of trade – to cooperate also in the realm of personal relationships. During the unifying process and the application of the functional theory1 it became conceivable that since the citizens of the Union roam freely in its area they would also deploy personal relationships, besides the commercial ones. The demand for harmonization of the civil law accordingly became bigger.
